Booking Conditions

 

1. WHO ARE WE

Freshwater Beach Holiday Park is the trading name of Freshwater Beach LLP, a limited liability partnership registered in England and Wales, Companies House Number OC434774. VAT registration number 186 1607 51. Members of the LLP are R Condliffe (Managing) and R Ireland. The principal place of business and registered office is Freshwater Beach Holiday Park, Burton Bradstock, Bridport, Dorset DT6 4PT

When you book your holiday your contract will be with that partnership and “we” “us” and “our” refer to that partnership.

 

2. WHO IS OUR CUSTOMER

(a) The person(s) named in the booking information is/are our customer(s) and references to “you” and “your” refer to such person(s), any such person making the booking must be 18 years of age or older.

 

3. BOOKINGS

(a) Your booking may not be transferred to anyone else.

(b) Bookings can be requested in the following ways:

(e) In person or by email giving all the details of your party or parties.  

3.1 You must tell us your full requirements, for example if you are bringing any vehicles, tents orother structures. We need this information when deciding whether we are able to accept your booking and we may not be able to accommodate changes. Where we are able to do so, there may be an additional charge.

3.2 Please make sure that you book all the dates you need. We are not able to guarantee that we will be able to extend your booking.  

 

4. THE PRICE YOU PAY

 (a)  Our prices include VAT.

 (b) The price will not be subject to any change unless the rate of VAT changes, or if you move your booking to another time of year or a different year.  

(c)  When you request your booking, you must pay a deposit of £20 per pitch for each touring pitch (touring caravan, campervan & Tent) or £100 for the hire of each Static caravan booked for your holiday or (if you are requesting to book 42 days (6 weeks) or less before the start date)the full price.

(d) Unless you paid in full when requesting your booking, the balance of the price of your holiday must be paid at least 42 days (6 weeks) before the start date.

(e) Authorised means of payment, you may pay us in the following ways;- 

In person at the Park office or by phone by credit or debit card.

Or by logging on to our guest portal quoting your booking reference number, or your email address and arrival date.

(f) It is your obligation to ensure that any balance of payment due to us is paid by the due date shown on your booking confirmation.  

 

4. THE CONTRACT

There will be a binding contract between you and us:-

(a) if you book in person or by telephone, at the time when we accept your deposit (or full payment if you are booking less than 42 days before the start of your holiday).

(b) if you book through an agent when the agent confirms the booking to us in writing.

(c) if you book online, when we confirm your booking in writing.

      “In writing” and written includes e-mail but not text messages.

(d) If you request a booking for more than one Pitch, then we may contact you before deciding

* whether to accept the booking to help us decide whether we are able to provide the holiday

* experience you are looking for.

The contract between you and us consists of the specific written booking details and these Booking Conditions.

6. RESERVATIONS

We will not accept any responsibility for errors arising from telephone requests not confirmed in writing. Cancellations or booking amendments must be notified to us in writing.

7.  YOUR PARTY

We provide holidays for families and couples. We, therefore, operate certain guidelines as to the  make-up of parties visiting our Park –

(a) The total number in your party (including children and babies) must not exceed the       maximum capacity which we specify for the caravan or pitch which you occupy.

(b) You must inform us if more than a half of your party comprises persons aged between 17 and 25. We reserve the right to refuse such a booking.

(c)  You must inform us if you wish to book a single sex party and provide the age of each member of the proposed party. Bookings from large single sex parties will not normally be accepted.

We reserve the right to refuse any booking.

 

8. PAYMENT REMINDERS

We are not obliged to send any reminder to you. Any reminder which we give to you is sent out of courtesy. Whether or not a reminder is given to you, we are entitled to treat the contract between us as terminated and may re-let the caravan or pitch previously reserved for you, if full payment is not received by the due date.


 

9. CARAVAN HOLIDAY HOMES

A deposit of £100 per week is required per caravan when booking. This deposit is non-refundable. The balance of rent is payable by you not less than 42 days in advance of your arrival. To avoid any disappointment please ensure your balance has reached us by the given time. Smoking is not permitted in our hire fleet caravans.

(a) A deposit of £100 is payable for each caravan in a single or block booking, with balances due no later than 42 days prior to your arrival. Bookings made less than 6 weeks in advance will require payment in full.

 

10. CHECKING IN TO YOUR CARAVAN HOLIDAY HOME

New arrivals must report to Reception. Although we will try to ensure that you are given the accommodation which you have booked, there may be circumstances where this is impossible or inadvisable. For this reason we may, at our discretion, allocate different accommodation to you.

Please check the inventory and the caravan on arrival and report any deficiencies within 24 hours. Damage and breakage to units or equipment during your period of occupation are your responsibility. They must be reported and paid for before departure. If you fail to report and pay for damage or breakage before your departure, you will be sent an invoice which must be paid within 14 days of the invoice date. At the end of your stay, please leave your caravan clean and tidy. If you leave the caravan in an extremely messy or untidy state, you will be charged for extra cleaning.

Hired Holiday Home Keys will be available after 3.00 pm. If arriving after 5.00 pm please notify Reception to arrange key collection. The period of your stay is from 3.00 pm on the day of arrival to 10.00 am on the day of departure.

If you wish to bring a pet with you, please refer to the relevant conditions below.

 

11. ARRIVALS AND DEPARTURES

 

(a) You must tell us by 1pm if you are likely to arrive later than 5pm. You may not arrive after 11pm. For bookings of more than one night, the earliest you may then arrive on the next day is 9am.

 

(b)  If we have not heard from you within 24 hours of your expected arrival, we may release your booking. You will only be entitled to a refund if a third party takes up your booking. In that event we will refund you up to the money we receive for the rebooking less our reasonable

administration charges.

 

(c) You must vacate by 10am on the day of your departure. An additional charge may be made for a late departure.

 

(d)  We will try to allocate you the location of your choice on the Park, but bookings are not conditional on this.  

 

(e) Your location on the Park and directions to it will be confirmed on arrival. If you are in any doubt, please check with us. Any guest staying in the wrong location may be required to move.


 

12. TOURING PITCHES

(a) A deposit of £20 per pitch is required for a touring caravan, tent, motorhome or caravanette per week or part thereof. This deposit is non-refundable. 

(b) The balance is payable 42 days (6 weeks) in advance of your arrival, see Condition 4f above. 

(c) New arrivals must report to Reception. 

(f) The period of your stay is from 12 noon on the day of arrival to 10.00 am on the day of departure. 

(g) For the comfort of all our customers no arrivals are permitted after 10.00 pm. 

(h) To comply with health and safety regulations you must pitch according to the instructions given to you on arrival. If you pitch incorrectly you will be instructed to move. 

(i) A six metre gap must be maintained between touring units for fire safety. The maximum dimensions for your accommodation (tourer excluding towbar, tent etc) is 23 ft (7m) x 14 ft (4.5m). 

(j) Specific pitches may be booked on request, subject to availability, however we reserve the right in our absolute discretion to amend pitch allocations for operational reasons. 

(k) As we allocate bookings to pitches, it may not always be possible to extend your stay and remain on the same pitch.

12.1 Our standard pitch price covers up to 6 people staying with

(a) Caravan, awning and car or

(b) Motor home and awning or

(c) Tent and car.

(d) We charge extra for boats, gazebos, utility tents, dogs and additional two man tents, extra people and extra cars.

(e) For safety reasons there are restrictions on the number of tents, gazebos and other objects permitted on individual pitches. Please contact Reception if you have any queries.

Toilet tents are not permitted onsite unless you require one for medical reasons. A valid medical certificate or doctor’s letter will be required in these circumstances.

12.2  BBQ's/Fire Pits

We allow free standing BBQ's. If you bring a disposable BBQ we can provide slabs so that the heat does not damage the grass. Please DO NOT put hot coals or disposable BBQ's in the wheelie bins.   

Fire Pits, burners or open fires of any description are NOT PERMITTED.

 

13. NOTICE OF CANCELLATION

If you wish to cancel your booking, in whole or part, your request to cancel must be made in writing to us at least 28 days before the first day of your booking, otherwise the balance outstanding will be payable by you and you will forfeit all of your deposit. We regret that in the event of leaving early for any reason, no refunds will be given. Charges apply for booking cancellation prior to commencing your holiday. These are dependent on the number of days’ notification you provide before your holiday was due to commence. If the deposit is greater than the percentage amount, then the charge is increased to the deposit amount. Notification of 56 days or more – the charge is 10% of the total holiday cost, 42 to 55 days – 30% of total holiday cost, 28 to 41 days – 50% of total holiday cost, 27 days or less – 100% of total holiday cost.

Very occasionally, in exceptional circumstances, we may have to cancel your booking. If we do so we will tell you as soon as possible. You will then be offered the option of a full refund or an alternative holiday booking with us at the brochure price. If we have to cancel because of circumstances beyond our control (e.g. fire, theft or flood) we will pay a full refund but no additional liability to you.

Cancellations due to weather conditions prevailing at the time are beyond our control and NO refunds will be given. You may, however, be able to move your booking to another time. Depending on the season extra charges may apply.  

 

CHANGES CAUSED BY EXCEPTIONAL CIRCUMSTANCES  

 

14. We may make reasonable changes to our Services. Our changes may reflect changes in relevant

laws, guidance and regulatory requirements or implement minor technical adjustments and

improvements, for example to address a health and safety risk.  

 

15. If we make changes which mean we can only provide your holiday in a radically different way, we will give you the choice between confirming your booking, agreeing new booking dates with us or cancelling. We prefer that you postpone rather than cancel but will always allow you to cancel

where the law gives you the right to do so.

 

16. If the law prevents us from performing our obligations under these Terms & Conditions at all, for any reason which is not the responsibility of either party, we may ask you to postpone but will

allow you to cancel if you prefer to do so. For these purposes, reasons which are your

responsibility include any arising from your personal circumstances. Examples are ill health

(except if the law prevents you from visiting or staying with us in consequence, for example

because you are legally required to self-isolate) and any restrictions arising from your chosen

career.  

 

17. If you decide to cancel where clause 15 or clause 16 applies and your holiday has not started,

then we will refund your booking including any deposit. If your holiday has started, then we will

refund any days unused. We will not charge an administration fee, and we will only deduct any

costs we have already incurred which we cannot recover elsewhere (‘Direct Costs’). We will not

be liable to make any other payment to you.

 

18. We may also cancel your holiday, or any unused days, if Government guidance means that you

should not visit or stay with us, even if the law still allows you to do so. If we cancel and your

holiday has not started, then we will refund your booking in full including any deposit. If your

holiday has started, then we will refund in full any days unused when we cancel. We will not

charge an administration fee and we will not deduct any Direct Costs.

 

19. You are not entitled to any refund if you or any of your guests leave before the end of your

holiday, unless clause 15 or clause 16 applies or if we are in serious breach of our obligations in

these Terms and Conditions. If we are in serious breach of our obligations, we will refund you for

the days of the holiday which have not been taken.  

 

20. We may also cancel your holiday if you breach any of these Terms and Conditions. 

    Clauses 40 - 41 give further details.

 

21. We recommend that you consider appropriate holiday insurance which covers any cancellation

charges and any additional losses which you may incur through cancellation of your holiday,

whether by you or by us. We are only responsible for any additional losses if you were entitled to

cancel because we were in serious breach of our obligations to you and the losses were both

directly caused by our breach and reasonably foreseeable by us when the booking was made.

 

22. PETS

If you wish to bring your pet(s) on your holiday, you must inform us at the time when you book your holiday. Dogs are not permitted in all of our static caravans. If you wish to bring your dogs on holiday we will allocate a designated static caravan to you in which dogs are permitted to stay.

(a)  Well trained dogs with responsible owners are welcome but please see below.

(b) A maximum of three dogs are permitted per touring pitch and 3 dog(s) per designated static caravan.

(c) We do not allow on our Park any type of dog listed under the Dangerous Dogs Act 1991 or which, in our opinion, resembles any such type. As a guide to you, dogs of any types resembling any of the following –

Pit Bull Terrier

Japanese Tosa

Dogo Argentina

Fila Braziliero

any other type of fighting dog will not be permitted on our premises.

(c) Please see charges for dogs in the touring prices.

(d) As a courtesy to other holidaymakers and no matter how well-behaved your dog, please ensure that your dog wears a collar and identity tag and is on a lead and under the control of a responsible person over the age of 18 years at all times while your dog is on the Park.

(e) Any dog found loose on the Park will be treated as a stray.

(f) Dog are permitted in certain designated areas of the Entertainment Complex and Jurassic Fun Centre.   We regret that no dogs (except registered assistance dogs) are allowed in the swimming pool areas, shop, children's play area, shower/toilet block or caravan holiday homes

(except caravans designated for pet use). 

(g) You must clean up immediately after your pet. A complimentary dog scoop is provided on   arrival. Owners who allow their pets to foul the grounds will be asked to leave the park and no refund will be given.

(h)  Dogs must not be left unattended at any time, day or night.

(i)  Registered assistance dogs for the disabled – Please inform us if your dog is a Registered Assistance dog for a disabled guest. We reserve the right, in our discretion, to require proof of registration. No charge will be made for Registered Assistance dogs but:- no more than one

Registered Assistance dog will be permitted per pitch or designated static caravan unless by specific written agreement with us; and other conditions applying to dogs on the Park apply.

(j) Other pets may be permitted at our discretion and subject to charges agreed prior to booking.

(k) No pet may be brought onto the Park, including any pet of a visitor, unless that pet is the subject of a documented guest booking.

 23. ALCOHOL CONSUMPTION

The licensees take their responsibility to prevent under age consumption of alcohol very seriously. Anyone who appears to be under 21 will be asked to provide photographic identification. We only accept the following forms of ID: Passport/Photo Driving Licence/Citizen Card/Prove It Card. Please ensure that young adults in your party are aware of this and bring acceptable ID if they wish to consume alcohol on the park.

24. ENTERTAINMENT COMPLEX AND JURASSIC FUN CENTRE

The Jurassic Fun Centre is open to the public between 1st September and 20th July to the general public. Admittance to the Entertainment Complex, Jurassic Fun Centre and swimming pools is by Holiday Pass or valid day ticket only. Children must be accompanied by an adult in the Entertainment Complex and Jurassic Fun Centre.

25. HOLIDAY PASSES

A Holiday pass will be provided on arrival to each person in your party. Please keep your Holiday Pass with you at all times. Your Holiday pass is valid until 10.00 am on the day of your departure. In case a Holiday pass is lost or mislaid we will supply a replacement at a cost of £5 per unexpired week or part of a week.

26. FACILITIES

Under normal circumstances most facilities are open and entertainment is provided between Spring Bank Holiday and early September. Outside this period facilities and opening times are reduced.

We welcome disabled visitors and the facilities onsite are accessible by wheelchair. However, footpaths adjoining Freshwater are not wheelchair accessible.

We reserve the right to suspend or change the entertainment and programme times and facilities such as the swimming pools without prior notice. No refunds will be given if facilities are closed for operational or maintenance reasons.

27. SWIMMING POOLS

Admittance to the swimming pools is by Holiday Pass only. The swimming pools must not be used outside the opening hours or when a lifeguard is not in attendance. All children under the age of 12 years must be accompanied by an adult in the swimming pool areas.

We do not allow inflatables in our pools.  Swimming aids are permitted.

All children under the age of 4 years must wear a swimming nappy.

During busy periods (including when the pools are open to the general public) access to the outdoor pool when open, is granted on a first come first served basis up to the maximum bather load of the pools. Once this limit has been reached, we reserve the right to refuse access to the pools until it is safe for additional people to enter. 

Entry to the indoor pools is restricted and bookable online up to 24 hours in advance, with one hour slots. If you book a slot and fail to arrive within 10 minutes, your slot maybe reallocated to someone else.  

You must follow the procedure for use of the swimming pool and all the separate rules applicable

to the pool. The rules and procedure are displayed at the swimming pool and are also available on

our website.  

28. TRAFFIC

Traffic movements are restricted after 11.00 pm to minimise disturbance in the touring and caravan areas. The speed limit is 10 mph and is strictly enforced.

29. VEHICLES 

(a)  You must insure all vehicles you use on the park as for use on the   public road.   

(b)  You must insure all accessories and items towed by vehicles (such as towed boats and jet skis) as for use on the public road.  

(c) You must not keep disused or un-roadworthy vehicles anywhere on the park. We reserve the right to remove any vehicle which is apparently abandoned.   

(d) You must not carry out the following works or repairs on the park:   

(e) Major vehicle repairs such as dismantling of part(s) of the engine works which involve the removal of oil or other fuels.   

f) Quad bikes, trials bikes and powered scooters are not permitted on the park. 

(g) You must not wash cars with a hosepipe.  

  30. DRIVING

  

(a) We permit cars onto the park for the purposes of access to the Caravan/accommodation/pitch only. Accordingly, save to the extent that you may need to do so because of a disability, you must not drive cars round the park for other purposes such as visiting other locations on the park.  

  

(b) Driving on the park is restricted to the park roads.  

  

(c) You must drive all vehicles on the park carefully and within the displayed speed limit.  

 

(d) You must hold a full current driving licence to drive any vehicle on the park.   

  

(e) You are not permitted to give anyone driving lessons at the park and we do not permit learner drivers to drive on the park.  

  

(f) There is a speed limit on all park roads of 10mph, which must be adhered to.  

  

(g) We allow a maximum of two motorised vehicle[s] to be parked alongside each pitch, subject to conditions.   

  

(h) Motorhomes/touring caravans cannot be parked alongside self-catering accommodation.  

  

(i) Electric cars cannot be charged at the park by any means, including the use of an electricity supply or hook-up.  

  

(j) The arrangements for charging electric cars are West Bay car park and East Street car park in Bridport.  

  

(k) You must not park anywhere except in the permitted parking spaces.   

  

(l) Visitors’ cars must be parked only in the allocated parking spaces for visitors, or in any space which the people they are visiting allow them to use in their place.   

  

(m) You must not park anywhere except in the parking space[s] allocated to you.   

  

(n) You may park not more than two car[s] at your Caravan/ accommodation/pitch, subject to conditions.  

  

(o) You must not park on the grass or roadsides.  

  

(q) Other than for delivering goods and services, you must not park or allow parking of commercial vehicles of any sort on the park, including:  

 

(r) Light commercial or light goods vehicles as described in the vehicle taxation legislation and vehicles intended for domestic use but derived from or adapted from such a commercial vehicle.

 

31. PLAYGROUND EQUIPMENT

The playground equipment must only be used by under 12 year olds. The playground area is closed between 9.00 pm and 9.00 am for the comfort of customers.

 

32. PROHIBITED ITEMS

The following are not permitted on the park:

Motorised scooters & e-scooters

Clothes lines

Ball games in the touring field

Skateboarding

Hover boards/Segway’s or similar

Drones

Radio controlled cars, helicopters, aeroplanes, gliders

 

33. ELECTRIC CARS

Electric cars CANNOT be charged from your hook up point, caravan power supply or through your caravan/motorhome or tent. This causes not only a health and safety issue with trailing leads but also exceeds the power supply to your caravan, thus putting a strain on neighbouring carvans/pitches and the Park supply in general. The nearest charging point for electric vehicle is located in the East Street carpark in Bridport.

 

34. POWER CUTS

There will be no compensation for loss of any kind due to power loss of less than 6 hours in any one day. If the power is lost for more than 6 hours in a day, then compensation of £5 for each such day will be paid.

 

35. WI-FI

We offer a free Wi-Fi service which is available in most areas of the park, including camping and static caravan areas.  We cannot guarantee good reception in all areas.  There is a daily device data transfer limit. This varies depending on total demand across the system.  Wi-Fi service may be interrupted and no compensation will be due.  Provision of free Wi-Fi does not form part of our contractual obligations.

 

36. VISITORS

As a courtesy, we permit residents to receive a limited number of visitors. We reserve the right in our discretion to withdraw this privilege in whole or part, without prior notice.

During peak holiday periods, customers’ guests;-

  1. Are not permitted to use the swimming pools or Entertainment Complex.

  2. Visitors with cars will not be accepted if there are already two cars on the customer’s pitch.

  3. Only people lawfully visiting with your permission have permission to enter the park.  

  4. Your visitors may not arrive before 10am and must leave the park by 10pm.  

Must pay for car parking, and must park by the inviting customer’s accommodation not in the car park. The maximum number of vehicles per pitch/caravan is two including the customer’s vehicle.

It is your responsibility to ensure that your visitors and all occupiers of your Caravan, tent or other

accommodation adhere to the Park Rules.  

  

37.  CURFEW

For everyone’s comfort and convenience customers are requested to return to their accommodation by 1.30 am.

 

38.  RECREATION

  

• You may only play ball and other games in the areas set aside for recreation. Ball games may only be played in the playing field area of the Park.

  

• Other ball games should be played away from caravans using a soft foam ball and again in the playing field.  

  

• You may not fly kites on the park anywhere near overhead cables.  

  

• You may not use drones, powered model aircraft or any other powered flying objects on the park.  

  

• You may not use skateboards, roller skates, rollerblades, e-scooters or micro scooters at the park.  

  

• You may not use any powered model car or similar toy on the park.   

  

39.  CHILDREN

  

(a) Children must be supervised whilst on the park and are the responsibility of their parent or

  guardian during their stay.   

  

(b)  Never allow children to play near or in the streams/rivers, as there are areas of deep water.    

  

(c) Children must not play on the play area before 9am or after 9pm.   

  

(d) Children under the age of 16 should not be left unsupervised in the accommodation or on the

park.  

  

(e) An adult must accompany small children to the toilets.  

 

40.  ANTI-SOCIAL BEHAVIOUR

The Park is a family park and therefore customers and their visitors are expected not to do, or allow to be done, anything which in the opinion of the management is detrimental to the enjoyment and comfort of other people staying on the Park. Anyone considered by the management to be acting in an anti-social manner will be required permanently to leave and no refund will be given.

 

Behaviour standards

 

These standards will apply from when you request your booking until your holiday ends. Unless stated otherwise, they apply whether or not you are on the Park at the time.  

 

You agree to, and you must make sure that you, your party and any visitors (including, in each case,

their children), keep to the following standards of behaviour:

 

(a) To act in a courteous and considerate manner towards us, our staff and anyone visiting, using or

      working on the Park including other customers.

 

(b) To supervise children so that they are not a nuisance or danger to themselves or other people 

      using the Park.

 

(c)  Commit any criminal offence (whether or not on the Park or in its vicinity) which causes  

       your name to be entered on the Violent and Sex Offender Register or causes you to be

       subject to a Risk of Sexual Harm Order or Child Abduction Warning Notice (or any

       register, order or notice succeeding these).

 

(d)  Use the Park in connection with any criminal activity or commit any other criminal offence  

        (i.e. any offence not already subject to clause 49.) at the Park or in its vicinity.

 

(e) Commit any acts of vandalism or nuisance on the Park.

 

(f) Use fireworks, Chinese lanterns or any similar open flame heat source on the Park.

 

(g) Keep or carry any firearm or any other weapon on the Park.

 

(h) Keep or use any unlawful drugs on the Park.

 

(i) Create undue noise or disturbance or commit antisocial behaviour on the Park.

 

(k) Carry on any trade or business at the Park.

 

(l) Permit anyone who is to your knowledge on the Violent and Sex Offender Register or  

    subject to a Risk of Sexual Harm Order or a Child Abduction Warning Notice (or any

        register, order or notice succeeding these) to use or visit the Park.

 

(m)  You agree that if you or any of your family members or visitors or guests whom you have    invited to the Park break the behaviour standards listed above then we may terminate your booking.

 

Ejection on grounds of behaviour 

  

In the event of persistent or serious misconduct by you, a member of your family, your occupiers,

visitors or guests, we will follow any relevant notice procedures in our agreement with you. We do

not have to follow any formal procedure to eject other visitors.  

 

41.  HEALTH AND SAFETY

(a) If whether on arrival at the Park or during your stay anyone in your party is known to have an infectious disease or other significant illness liable to be transmitted from person to person, please would you inform us. We would then expect you to comply with such precautions for the protection of other occupants and users of the Park as we request including, if necessary, the termination of your stay at the Park.

(b) For hygiene reasons, customers who have suffered from a stomach illness during the preceding 14 days’ must not use the swimming pools.

(c) We are always striving to ensure the safety of our Park and its facilities. Please inform us of any significant accident to any member of your party on the Park. Please also inform us of any hazard which you identify on the Park.

(d)  Equipment and facilities in our public buildings, private accommodation and generally around the park should only be used as intended. Misuse could lead to our termination the contract between us and/or seeking reimbursement for damage. 

(e)  You must obey all health and safety notices displayed on the park and act on the reasonable

instructions of park staff in matters of health and safety.  

 

  

42. DATA PROTECTION

We hold any information which you have provided to us in connection with your booking on our computer system. This information is used in accordance with Data Protection legislation. By providing this information to us, you, and everyone else in your party whose information is provided to us by you, is deemed to accept our usage of the information relating to them. Please ensure that the other members of your party agree to this. Any personal data you give to us will be processed in accordance with the law and our privacy policy.

 

43. CCTV

We use CCTV cameras in some parts of the Park to assist in detection and prevention of crime and to maintain safety.

44. LIMITATIONS OF LIABILITY

We accept responsibility for those arrangements of your holiday which are within our control, but we cannot accept liability for any injury, loss or damage suffered by you or any other member of your party, unless one of the following applies:

(a)  there was wilful default or gross negligence by us, our employees or agents

(b)  death or personal injury occurs as a result of our negligent act or default or the negligent   act or default of our employee or agent

For all claims other than death or personal injury, which result from the non-performance or improper performance of our contract, we will pay compensation that is reasonable in all such circumstances. However, our liability to you in such circumstances is limited to the total cost of the holiday paid as per your final holiday invoice from us. Please notify any shortcomings or complaints to the Reception/Duty Manager immediately, so that they can be remedied. Claims may be reduced or rejected if we have not been given the opportunity to put matters right or investigate your concerns.

If you cut your holiday short we are not obliged to offer a refund.

 

45. WEATHER DAMAGE AND OTHER CIRCUMSTANCES BEYOND OUR CONTROL

Customers are responsible for monitoring the weather conditions and ensuring their equipment is suitable. We are not responsible for any damage or injury to person or property arising as a result of weather damage or other circumstances beyond our control, including flooding or wind damage.

WE RESERVE THE RIGHT TO REFUSE ADMISSION TO OR REMOVE ANY PERSON OR PERSONS CAUSING UNNECESSARY NUISANCE OR NOISE WITHOUT REFUND OR PRIOR NOTICE.

 

THE BEACH AT FRESHWATER SHELVES STEEPLY AND AT ANY STATE OF THE TIDE THERE MAY BE STRONG CURRENTS AND UNDERTOW. CAUTION IS ADVISED AND CHILDEN IN PARTICULAR SHOULD BE CLOSELY SUPERVISED AT ALL TIMES.

ENJOY OUR NATURAL ENVIRONMENT SAFELY

Please take care when in the countryside and always supervise your children. We want you to have a fun and safe holiday at Freshwater.

Cliffs – don’t go too near the edge; don’t walk or sit right at the base of the cliffs because of potential rock falls.

Sea, River and Swimming Pools – always supervise your children when they are in or near water including the swimming pools; be aware that the beach shelves steeply; don’t swim or paddle when the sea is rough; there is no lifeguard service on the beach.

Uneven surfaces and potholes – these are a feature of the countryside; be careful not to trip or slip on rough ground especially where animals have been burrowing.

 

46. CHANGES TO PARK RULES

It may be necessary or desirable to change the Park Rules from time to time including for reasons of health and safety, the efficient running of the park, environmental issues, local authority requirements and/or changes in laws or regulations or in the interpretation of laws or regulations imposed upon us, in which case we will notify you in writing be email.
