Terms and Conditions
1. WHO ARE WE
Freshwater Beach Holiday Park is the trading name of R. Condliffe (Managing Partner) and M. Ireland of Freshwater Caravan Park. When you book your holiday your contract will be with that partnership and "we" "us" and "our" refer to that partnership.
2. WHO IS OUR CUSTOMER
The person(s) named in the booking information is/are our customer(s) and references to "you" and "your" refer to such person(s). Your booking may not be transferred to anyone else.
3. THE CONTRACT
There will be a binding contract between you and us:-
(a) if you book in person or by telephone, at the time when we accept your deposit (or full payment if you are booking less than 42 days before the start of your holiday).
(b) if you book through an agent when the agent confirms the booking to us in writing.
(c) if you book online, when we confirm your booking in writing.
"In writing" and written includes e-mail but not text messages.
The contract between you and us consists of the specific written booking details and these Booking Conditions.
4. YOUR PARTY
We provide holidays for families and couples. We, therefore, operate certain guidelines as to the make up of parties visiting our Park -
(a) The total number in your party (including children and babies) must not exceed the maximum capacity which we specify for the caravan or pitch which you occupy.
(b) You must inform us if more than a half of your party comprises persons aged between 17 and 25. We reserve the right to refuse such a booking.
(c) You must inform us if you wish to book a single sex party and provide the age of each member of the proposed party. Bookings from large single sex parties will not normally be accepted.
We will not accept any responsibility for errors arising from telephone requests not confirmed in writing. Cancellations or booking amendments must be notified to us in writing.
6. PAYMENT REMINDERS
It is your obligation to ensure that any balance of payment due to us is paid by the due date. We are not obliged to send any reminder to you. Any reminder which we give to you is sent out of courtesy. Whether or not a reminder is given to you, we are entitled to treat the contract between us as terminated and may re-let the caravan or pitch previously reserved for you, if full payment is not received by the due date.
7. CARAVAN HOLIDAY HOMES
A deposit of £100 per week is required when booking caravan holiday homes. This deposit is non-refundable. The balance of rent is payable by you not less than 42 days in advance of your arrival. To avoid any disappointment please ensure your balance has reached us by the given time. Smoking is not permitted in our hire fleet caravans.
8. CHECKING IN TO YOUR CARAVAN HOLIDAY HOME
New arrivals must report to Reception. Although we will try to ensure that you are given the accommodation which you have booked, there may be circumstances where this is impossible or inadvisable. For this reason we may, at our discretion, allocate different accommodation to you.
Please check the inventory and the caravan on arrival and report any deficiencies within 24 hours. Damage and breakage to units or equipment during your period of occupation are your responsibility. They must be reported and paid for before departure. If you fail to report and pay for damage or breakage before your departure, you will be sent an invoice which must be paid within 14 days of the invoice date. At the end of your stay, please leave your caravan clean and tidy. If you leave the caravan in an extremely messy or untidy state, you will be charged for extra cleaning.
Hired Holiday Home Keys will be available after 3.00 pm. If arriving after 5.00 pm please notify Reception to arrange key collection. The period of your stay is from 3.00 pm on the day of arrival to 10.00 am on the day of departure.
If you wish to bring a pet with you, please refer to the relevant conditions below.
9. TOURING PITCHES
A deposit of £20 per pitch is required for a touring caravan, tent, motorhome or caravanette per week. This deposit is non-refundable. The balance is payable 42 days in advance of your arrival, see Condition 6 above. New arrivals must report to Reception. The period of your stay is from 12 noon on the day of arrival to 10.00 am on the day of departure. For the comfort of all our customers no arrivals are permitted after 10.00 pm. To comply with health and safety regulations you must pitch according to the instructions given to you on arrival. If you pitch incorrectly you will be instructed to move. A six metre gap must be maintained between touring units for fire safety. The maximum dimensions for your accommodation (tourer excluding towbar, tent etc) is 23 ft (7m) x 14 ft (4.5m). Specific pitches may be booked on request, subject to availability, however we reserve the right in our absolute discretion to amend pitch allocations for operational reasons. As we allocate bookings to pitches, it may not always be possible to extend your stay and remain on the same pitch.
Our standard pitch price covers up to 6 people staying with
a) caravan, awning and car or
b) motor home and awning or
c) tent and car.
We charge extra for boats, gazebos, dogs and additional two man tents, extra people and cars.
For safety reasons there are restrictions on the number of tents, gazebos and other objects permitted on individual pitches. Please contact Reception if you have any queries.
10. NOTICE OF CANCELLATION
If you wish to cancel your booking, in whole or part, your request to cancel must be made in writing to us at least 28 days before the first day of your booking, otherwise the balance outstanding will be payable by you and you will forfeit all of your deposit. We regret that in the event of leaving early for any reason, no refunds will be given. Charges apply for booking cancellation prior to commencing your holiday. These are dependent on the number of days' notification you provide before your holiday was due to commence. If the deposit is greater than the percentage amount, then the charge is increased to the deposit amount. Notification of 56 days or more - the charge is 10% of the total holiday cost, 42 to 55 days - 30% of total holiday cost, 28 to 41 days - 50% of total holiday cost, 27 days or less - 100% of total holiday cost.
Very occasionally, in exceptional circumstances, we may have to cancel your booking. If we do so we will tell you as soon as possible. You will then be offered the option of a full refund or an alternative holiday booking with us at the brochure price. If we have to cancel because of circumstances beyond our control (e.g. fire, theft or flood) we will pay a full refund but no additional liability to you.
If you wish to bring your pet(s) on your holiday, you must inform us at the time when you book your holiday. Dogs are not permitted in all of our static caravans. If you wish to bring your dogs on holiday we will allocate a designated static caravan to you in which dogs are permitted to stay.
(a) Well trained dogs with responsible owners are welcome but please see (b) below. A maximum of three dogs are permitted per touring pitch and 3 dog(s) per designated static caravan.
(b) We do not allow on our Park any type of dog listed under the Dangerous Dogs Act 1991 or which, in our opinion, resembles any such type. As a guide to you, dogs of any types resembling any of the following -
Pit Bull Terrier
any other type of fighting dog will not be permitted on our premises.
(c) Please see charges for dogs in the touring prices.
(d) As a courtesy to other holidaymakers and no matter how well-behaved your dog, please ensure that your dog wears a collar and identity tag and is on a lead and under the control of a responsible person over the age of 18 years at all times while your dog is on the Park.
(e) Any dog found loose on the Park will be treated as a stray.
(f) We regret that no dogs (except registered assistance dogs) are allowed in the swimming pool areas, Entertainment Complex, Jurassic Fun Centre, shop, children's play area, shower/toilet block or caravan holiday homes (except caravans designated for pet use).
(g) You must clean up immediately after your pet. A complimentary dog scoop is provided on arrival. Owners who allow their pets to foul the grounds will be asked to leave the park and no refund will be given.
(h) Dogs must not be left unattended at any time, day or night.
(i) Registered assistance dogs for the disabled - Please inform us if your dog is a Registered Assistance dog for a disabled guest. We reserve the right, in our discretion, to require proof of registration. No charge will be made for Registered Assistance dogs but:-
no more than one Registered Assistance dog will be permitted per pitch or designated static caravan unless by specific written agreement with us; and
other conditions applying to dogs on the Park apply.
(j) Other pets may be permitted at our discretion and subject to charges agreed prior to booking.
(k) No pet may be brought onto the Park, including any pet of a visitor, unless that pet is the subject of a documented guest booking.
12. ALCOHOL CONSUMPTION
The licensees take their responsibility to prevent under age consumption of alcohol very seriously. Anyone who appears to be under 21 will be asked to provide photographic identification. We only accept the following forms of ID: Passport/Photo Driving Licence/Citizen Card/Prove It Card. Please ensure that young adults in your party are aware of this and bring acceptable ID if they wish to consume alcohol on the park.
13. ENTERTAINMENT COMPLEX AND JURASSIC FUN CENTRE
The Jurassic Fun Centre is open to the public between 1st September and 20th July. Admittance to the Entertainment Complex, Jurassic Fun Centre and swimming pools is by Holiday Pass or valid ticket only. Children must be accompanied by an adult in the Entertainment Complex and Jurassic Fun Centre.
14. HOLIDAY PASSES
A Holiday pass will be provided on arrival to each person in your party. Please keep your Holiday Pass with you at all times. Your Holiday pass is valid until 10.00 am on the day of your departure. In case a Holiday pass is lost or mislaid we will supply a replacement at a cost of £5 per unexpired week or part of a week.
Under normal circumstances all facilities are open and entertainment is provided between Spring Bank Holiday and early September. Outside this period facilities and opening times are reduced.
We welcome disabled visitors and the facilities onsite are accessible by wheelchair. However, footpaths adjoining Freshwater are not wheelchair accessible.
We reserve the right to suspend or change the entertainment and programme times and facilities such as the swimming pools without prior notice. No refunds will be given if facilities are closed for operational or maintenance reasons.
16. SWIMMING POOLS
Admittance to the swimming pools is by Holiday Pass only. The swimming pools must not be used outside the opening hours or when a lifeguard is not in attendance. All children under the age of 12 years must be accompanied by an adult in the swimming pool areas.
All children aged 4 and under must wear a swim nappy in order to enter the pool. Staff reserve the right to refuse entry in to the pool if any child 4 and under is found not to be wearing a swim nappy. Swim nappies can be bought in the JFC reception and the Spar shop on site. Please note: no refunds will be given if entry is refused due to non wearing of swim nappies.
Take care, swimming pools can be hazardous, Water prevents a risk of drowning and injuries can occur from hitting the hard surrounds or from misuse of the equipment.
Every pool is different, so make sure you know how deep the water is and check for other hazards, such as addition wet play equipment.
Always swim within your ability:
Never swim after a heavy meal or after alcohol. Avoid holding your breath and swimming for long distances under water. Be especially careful if you have a medical condition such as asthma, diabetes or heart problems.
Should you have any issues when using the pool facilities please speak with the Pool Supervisor on duty, he/ she will then try to rectify this or consult with the Pool Manager.
Under 12’s must be accompanied at all times when in the pool area.
No outside shoes beyond this point
All non swimmers to be accompanied by an adult in the water
No Diving – outside pool only at 2 metres
No running on the poolside environment
No flippers in the pool
No inflatables (except at the lifeguards discretion)
No drinking glasses or crockery around the pool area
No acrobatics or boisterous behaviour
No ball games (Outside pool only at lifeguards discretion)
Please consult your doctor before using the pool area and equipment if you suffer from a medical condition
No breast feeding in the pool
The Jurassic Fun Centre is not responsible for any belongings left unattended
If you require any assistance please ask a lifeguard
WARNING – CCTV is in operation in the pool area for health and safety purposes
Floats to be used as swimming aids only
Food is not permitted in the indoor pool area
The use of vaporizer’s is not permitted
Additional outside pool rules:
No animals in pool area
This centre operates a pre pay system whereby payment must be made in full prior to entrance unless you are on holiday in which you will have your holiday pass / owners pass issued to you.
Refunds will only be issued in accordance with the Supply of Goods and Services Act 1982, when we, the centre, are unable to fulfil our side of the contract, e.g. because of pool closures or equipment not working and we are unable to rectify the issue within a reasonable amount of time.
Terms & Conditions
All guests / users of the swimming pool facilities (Pools, sauna, steam, hot tub & Gym) and changing facilities are expected to abide by the pool rules, terms and conditions of use and Freshwater Beach Holiday Park (FBHP) reserve the right to deny access to the Pool Facilities of any user who is deemed by FBHP to have failed to comply.
The use of the swimming pool facilities cannot be transferred – the swimming pool facilities are provided for use by holiday customers and paying members of the public
Any outside organisation hiring the pool by special arrangement will need to contact the Pool Manager to arrange appropriate qualified Lifeguard cover.
There may be occasions when water testing results require pool closure for a short period of time, this cannot be helped. This is for bather safety; reception will inform customers that certain facilities are closed prior to entry.
A gym induction must be completed prior to the use of the gym and the induction card carried at all times for inspection if required.
Freshwater Beach Holiday Park / Jurrasic Fun Centre Operate under strict guidelines and rules in the form of NOP’s (Normal Operating Plan’s), EAP’s (Emergency Action Plan) along with Risk Assessments and Approved Codes of Practice.
Recent Health Problems – Customers who have had joint replacements or bone fractures in the last 12 months are strongly advised not to use the wet play equipment e.g splash pad, fun pool, slide.
Please shower – please ensure you shower thoroughly before entering the pool. Always encourage children to use the toilet and shower before they swim.
Recent illness – please do not swim if you have suffered from a stomach upset in the last 14 days
For help getting in and out of the pool, please ask a lifeguard for assistance. A hoist is available
Traffic movements are restricted after 11.00 pm to minimise disturbance in the touring and caravan areas. The speed limit is 10 mph and is strictly enforced. We do not permit the use of any non road legal motorised vehicles e.g. mini scooters, quad bikes etc. All vehicles on park must be taxed, insured and have passed the MOT regulations. Commercial vehicles are only accepted by prior arrangement.
18. PLAYGROUND EQUIPMENT
The playground equipment must only be used by under 12 year olds. The playground area is closed between 9.00 pm and 9.00 am for the comfort of customers.
19. PROHIBITED ITEMS
The following are not permitted on the park:
Ball games in the touring field
Hoverboards/Swegways or similar
Radio controlled cars, helicopters, aeroplanes, gliders
Flying Chinese Lanterns. These are prohibited in all areas of our site because they are a serious fire hazard to the public and agriculture land.
20. POWER CUTS
There will be no compensation for loss of any kind due to power loss of less than 6 hours in any one day. If the power is lost for more than 6 hours in a day, then compensation of £5 for each such day will be paid.
We offer a highly restricted free Wi-Fi service and various options to upgrade with more data and faster service.
Although Wi-Fi is available in most areas of the park including camping and static caravan areas, we cannot guarantee good reception in all areas. Tickets can only be used on one device at a time and there is a daily individual data transfer limit. This varies depending on the type of ticket purchased. Refunds are only available after 4 hours without service and will be proportional to the amount of data already used out of the daily quote.
As a courtesy, we permit residents to receive a limited number of visitors. We reserve the right in our discretion to withdraw this privilege in whole or part, without prior notice.
During peak holiday periods customers' guests:
" are not permitted to use the swimming pools or Entertainment Complex
" are required to leave the park by 10pm
" must pay for car parking, and must park by the inviting customer's accommodation not in the car park. The maximum number of vehicles per pitch/caravan is two including the customer's vehicle.
" Visitors with cars will not be accepted if there are already two cars on the customer's pitch.
" remain the responsibility of the customer who invited them at all times when they are on the park.
For everyone's comfort and convenience customers are requested to return to their accommodation by 1.30 am.
24. ANTI-SOCIAL BEHAVIOUR
The Park is a family park and therefore customers and their visitors are expected not to do, or allow to be done, anything which in the opinion of the management is detrimental to the enjoyment and comfort of other people staying on the Park. Anyone considered by the management to be acting in an anti-social manner will be required permanently to leave and no refund will be given.
25. HEALTH AND SAFETY
(a) If whether on arrival at the Park or during your stay anyone in your party is known to have an infectious disease or other significant illness liable to be transmitted from person to person, please would you inform us. We would then expect you to comply with such precautions for the protection of other occupants and users of the Park as we request including, if necessary, the termination of your stay at the Park.
(b) For hygiene reasons, customers who have suffered from a stomach illness during the preceding 14 days' must not use the swimming pools.
(c) We are always striving to ensure the safety of our Park and its facilities. Please inform us of any significant accident to any member of your party on the Park. Please also inform us of any hazard which you identify on the Park.
26. DATA PROTECTION
We hold any information which you have provided to us in connection with your booking on our computer system. This information is used in accordance with Data Protection legislation. By providing this information to us, you, and everyone else in your party whose information is provided to us by you, is deemed to accept our usage of the information relating to them. Please ensure that the other members of your party agree to this.
We use CCTV cameras in some parts of the Park to assist in crime prevention and to maintain safety.
28. LIMITATIONS OF LIABILITY
We accept responsibility for those arrangements of your holiday which are within our control, but we cannot accept liability for any injury, loss or damage suffered by you or any other member of your party, unless one of the following applies:
(1) there was wilful default or gross negligence by us, our employees or agents
(2) death or personal injury occurs as a result of our negligent act or default or the negligent act or default of our employee or agent
For all claims other than death or personal injury, which result from the non-performance or improper performance of our contract, we will pay compensation that is reasonable in all such circumstances. However, our liability to you in such circumstances is limited to the total cost of the holiday paid as per your final holiday invoice from us. Please notify any shortcomings or complaints to the Reception/Duty Manager immediately, so that they can be remedied. Claims may be reduced or rejected if we have not been given the opportunity to put matters right or investigate your concerns.
If you cut your holiday short we are not obliged to offer a refund.
29. WEATHER DAMAGE AND OTHER CIRCUMSTANCES BEYOND OUR CONTROL
Customers are responsible for monitoring the weather conditions and ensuring their equipment is suitable. We are not responsible for any damage or injury to person or property arising as a result of weather damage or other circumstances beyond our control, including flooding or wind damage.
WE RESERVE THE RIGHT TO REFUSE ADMISSION TO OR REMOVE ANY PERSON OR PERSONS CAUSING UNNECESSARY NUISANCE OR NOISE WITHOUT REFUND OR PRIOR NOTICE.
THE BEACH AT FRESHWATER SHELVES STEEPLY AND AT ANY STATE OF THE TIDE THERE MAY BE STRONG CURRENTS AND UNDERTOW. CAUTION IS ADVISED AND CHILDEN IN PARTICULAR SHOULD BE CLOSELY SUPERVISED AT ALL TIMES.
ENJOY OUR NATURAL ENVIRONMENT SAFELY
Please take care when in the countryside and always supervise your children. We want you to have a fun and safe holiday at Freshwater.
Cliffs - don't go too near the edge; don't walk or sit right at the base of the cliffs because of potential rock falls.
Sea, River and Swimming Pools - always supervise your children when they are in or near water including the swimming pools; be aware that the beach shelves steeply; don't swim or paddle when the sea is rough; there is no lifeguard service on the beach.
Uneven surfaces and potholes - these are a feature of the countryside; be careful not to trip or slip on rough ground especially where animals have been burrowing.
30. BBQ's/ FIRE PITS.
We allow free standing BBQ's. If you bring a disposable BBQ we can provide slabs so that the heat does not damage the grass. Please DO NOT put hot coals or disposable BBQ's in the wheelie bins as they will catch fire. we DO NOT allow fire pits, burners or open fires OF ANY kind.
